These General Terms & Conditions (“Terms”) govern all services provided by The Halfway Living, a sole proprietorship registered in Lachen SZ, Switzerland. By engaging our services, submitting a booking request, or making payment against any invoice, you acknowledge and agree to be bound by these Terms.
1. Scope of Services
The Halfway Living provides concierge, relocation, itinerary design, lifestyle support, and travel-related services. The scope of each engagement is defined in writing prior to commencement. Only services expressly confirmed in writing are included. All other services will be subject to separate fees.
2. Booking & Confirmation
• Bookings are binding only upon written confirmation by The Halfway Living.
• Any verbal or informal requests are non-binding until confirmed in writing.
• The Halfway Living reserves the right to decline or cancel a booking at its sole discretion.
3. Fees & Payment
• Fees are calculated according to the agreed service structure (daily rate, project fee, or percentage fee).
• Invoices are due immediately upon issuance unless otherwise stated.
• Deposits are non-refundable unless otherwise agreed in writing.
• Payment must be made by bank transfer, credit card, or other approved methods.
• The Halfway Living reserves the right to withhold, suspend, or cancel services in case of delayed or incomplete payment.
4. Cancellations & Changes
• Cancellations must be communicated in writing.
• Refund eligibility is strictly limited to cases where services have not commenced and no third-party costs have been incurred.
• All third-party costs (hotels, transportation, tickets, external providers) are strictly non-refundable.
• Requests for changes are subject to approval and may incur additional charges.
• Failure to appear (“no-show”) is considered a full cancellation and will be charged in full.
5. Client Responsibilities
• Clients must provide timely, accurate, and complete information required for the provision of services.
• The Halfway Living accepts no liability for delays, costs, or failures resulting from inaccurate, incomplete, or late information provided by the client.
• Clients are responsible for compliance with all applicable travel, immigration, health, and safety requirements.
6. Third-Party Providers
• The Halfway Living may engage trusted third-party providers on behalf of clients.
• The Halfway Living acts solely as an intermediary and assumes no liability for the performance, conduct, or failure of third-party providers.
• Clients agree that any claims or disputes must be addressed directly with the third-party provider.
7. Force Majeure
The Halfway Living shall not be held liable for any delay, alteration, or failure to perform resulting from circumstances beyond its reasonable control, including but not limited to natural disasters, strikes, accidents, pandemics, government restrictions, war, civil unrest, or failure of suppliers.
8. Liability
• The Halfway Living’s liability is strictly limited to the amount of fees paid by the client for the specific service giving rise to a claim.
• Under no circumstances shall The Halfway Living be liable for indirect, incidental, or consequential damages, including but not limited to loss of enjoyment, business loss, financial loss, or reputational damage.
•Nothing in these Terms shall limit liability in cases of proven gross negligence or wilful misconduct.
9. INDEMNITY
The client agrees to indemnify and hold harmless The Halfway Living, its owner, employees, and partners from any claims, damages, costs, or liabilities arising out of the client’s use of services, breach of these Terms, or third-party claims connected to the engagement.
10. Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
11. Governing Law & Jurisdiction
These Terms are governed exclusively by Swiss law. The exclusive place of jurisdiction is Lachen, Canton of Schwyz, Switzerland.
